This page (together with the documents referred to on it) specify the terms and conditions (“Terms & Conditions”) on which we supply any of the products (“Products”) listed on our website www.homefreshceylon.com (the “Site”) to you. Please read these Terms & Conditions carefully before ordering any Products from the Site. You should understand that by ordering any of the Products, you agree to be bound by these Terms & Conditions. Please also note that the use of the Site is subject to the terms contained in the Disclaimer document, which apply whether or not you order any Products from the Site. 01. Information about us
The Site is operated by Home Fresh Products (“we” / “us”). We are registered in the Department of Provincial Registrar of Business Names for the Western Province Sri Lanka under DE/000620 and our office is at No. 56B, Vishnu Kovila Road, Nedimala, Dehiwala Sri Lanka.
02. The Terms & Conditions – Customer Service Contact Information.
In respect of Goods and Services provided by the Merchant by means of the Internet based transactions, the merchant shall clearly indicate and display the following on Merchant’s Website:
A] Return, Refund, and cancellation policy.
B] Shipping and/or delivery policy
C] Merchant’s customer service contact information
2.1You may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the “Make Payment” button on the “Payment Details” page.
2.2 After placing an order, you will receive an e-mail (the “Order Confirmation”) from us acknowledging receipt of order , an order reference number , and a summary of your purchase. The contract between us will only be formed when you receive the Dispatch Confirmation by us.
2.3 We may choose not to accept your order for any reason, and we will not be liable to you or to anyone else in those circumstances.
2.4 We may be unable to process your order if:
The Product you ordered is out of stock or discontinued,
OR,
There is a problem with the authorization of the payment on your credit /debit card.
03. Price and Payment
3.1 The price of any Products will be as quoted on our Site from time to time, except in cases of obvious error.
3.2 These prices are excluding any government import duty & taxes in your country. it is advisable to check upto what value you can import without any duty or taxes.
3.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent payment confirmation.
3.4 We cannot complete the order until you have confirmed the payment option. Payment can be made by most major credit/debit cards or bank transfers, by completing the relevant details on the “Payment Details” page.
3.5 By using a credit/debit card to pay for your order, you confirm that the card/account being used is yours or you are authorized by the primary card holder. All credit /debit card account holders are subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment, we will not accept your order, and we will not be liable for any delay or non-delivery, and we are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

Our Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our Site may be incorrectly priced. We will rectify any such errors as soon as possible once we become aware of them. If a Product’s correct price is different from the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
3.7 Sales, promotions, discounts, and coupons cannot be combined.
04. Delivery
4.1 Delivery of orders are contracted to a 3rd party and we will generally deliver all Products comprised in your order in one delivery. We will deliver directly to the delivery address specified in your order. We cannot deliver items within the same order to multiple addresses. If you are not in to receive your Delivery – you will be required to liaise with the delivery partner (courier company) for alternative arrangement.
05. Risk and Ownership
5.1 Once delivered, the Products ordered will become your responsibility, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered. We will not accept any liability for their loss, damage, or destruction after they have been delivered.
5.2 Ownership of the Products will only pass to you on delivery of the Products to you
06. Our cancellation, returns and refund policy
6.1 We can accept any cancellation provided that the order has not been dispatched.
6.2 Orders which have already been dispatched cannot be cancelled or refunded.
6.3 An exchange or a refund will be entertained on a case by case basis and on review by the management. An exchange or a refund will be possible if the items are damaged in transit, defected or incorrect. In such a situation Home Fresh Products must be informed within 02 days of receipt of goods. Exchange or refund will be accepted provided the product is not used.
6.4 All Sale tab/ promotional items are non-refundable.

07. Our liability
7.1 We accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity, and other similar losses,) (liability for death or personal injury caused by our negligence, or our responsibility for fraudulent misrepresentation and any other liability that cannot), under Democratic Republic Law of Sri Lanka law.
7.2 The Contract shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. The courts of the Democratic Socialist Republic of Sri Lanka shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Contract (including any question regarding its subject matter, existence, validity or termination and including noncontractual disputes or claims).
7.3 We shall be not liable for any loss, damage, delay, mis-delivery, non-delivery not caused by its own negligence, or for any loss, damage, delay, mis-delivery, or non-delivery caused by:
A] Acts of God, perils of the air, enemies, public authorities acting with actual or apparent authority or law, acts, or omission of postal, customs or other government officials, riots, strikes, or other local disputes, hazard incidents to a state of war, weather conditions, temperature or atmospheric changes or conditions, mechanical or other delay, of any aircraft used in providing transportation services or any other cause reasonably beyond our control.
B] Acts or omissions of any service, Courier, forwarder, or any other entity to whom a shipment is tendered by us for transportation, regardless of whether the shipper requested or had knowledge of such third-party delivery requirement.
C] While we will Endeavor to exercise its best efforts to provide expeditious delivery in accordance with regular schedules, we will not under any circumstances be liable for delay in pick-up, transportation, or delivery of any shipment regardless of the causes of such delay.
7.4 Nothing in this section 7 or elsewhere in our Terms & Conditions affects your statutory legal rights.

09. Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control
10. General
10.1 If any of these Terms & Conditions are declared invalid, unlawful, or unenforceable, then that provision shall be deemed to be deleted from these Terms & Conditions and the remaining provisions shall remain in full force and effect.
10.2 We have the right to revise and amend these Terms & Conditions from time to time without prior notice, by changing them on the Site, provided that any such change will not affect any purchases you have made before the change is implemented.
10.3 Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms & Conditions.
10.4 You and we agree that Sri Lankan law applies to these Terms & Conditions and that any dispute between us arising out of or in connection with these Terms & Conditions will only be dealt with by the Sri Lankan courts. We are required by law to inform you that purchases can be concluded in English only and that no public filing requirements apply.
